These Terms of Service ("Terms") govern your access to and use of The Entertainment Marketplace website, including this pre-launch "founding roster" version of the site (together, the "Site"), operated by The Entertainment Marketplace ("the Company," "we," "us," or "our"). By creating an account, submitting an entertainer listing, or otherwise using the Site, you agree to these Terms. If you do not agree, do not use the Site.
If you are creating a listing on behalf of a business, you represent that you have the authority to bind that business to these Terms.
The Entertainment Marketplace is a directory and inquiry platform, not a booking agent, event-services company, or payment processor for bookings. We connect customers searching for entertainers ("Customers") with entertainers who list their acts on the Site ("Entertainers"). Customers submit inquiries directly to Entertainers through the Site; all quoting, negotiating, contracting, and payment for an actual performance happens directly between the Customer and the Entertainer, outside the Site. We are not a party to, and assume no responsibility for, any booking, contract, or transaction between a Customer and an Entertainer.
The only payment the Site itself processes is an Entertainer's own listing fee, described in Section 6 and in the Entertainer Listing Agreement.
You must be at least 18 years old and able to form a binding contract to use the Site. When you create an account, you agree to provide accurate information and to keep your login credentials confidential. You are responsible for all activity under your account. Notify us promptly if you believe your account has been compromised.
Entertainers who create a listing agree to the Entertainer Listing Agreement in addition to these Terms, which covers listing tiers, fees, founding-member pricing, review and approval, and related terms in detail.
Customers may search listings and submit inquiries free of charge. We do not guarantee that any Entertainer will respond to an inquiry, that an Entertainer is available for a given date, or that any listing is fully accurate or current — Entertainers are solely responsible for the accuracy of their own profiles. Customers are responsible for vetting any Entertainer (references, licensing, insurance, contracts, etc.) before booking.
Entertainer listing fees are processed through Stripe, our third-party payment processor. We do not store your full payment card details — Stripe handles that directly. By submitting payment, you authorize the applicable listing fee to be charged as described at checkout and in the Entertainer Listing Agreement.
No payment for an actual performance, deposit, or booking is ever collected, held, or processed by the Site. Any such payment is handled entirely between Customer and Entertainer.
"Content" means any text, photos, videos, bios, or other material you submit to the Site. You retain ownership of your Content. By submitting Content, you grant the Company a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute that Content on the Site (and in related marketing of the Site) for as long as your listing or account is active, and for a reasonable period after to reflect removal. You represent that you own or have the necessary rights to any Content you submit, and that it does not infringe any third party's rights.
The Site relies on third-party providers to operate, including Stripe (payments), Supabase (account and data storage), Resend (transactional email), and Netlify (hosting). Your use of the Site is also subject to those providers' own terms where applicable. If you opt into the optional Tamarisk Marketing add-on at signup, that service is provided by Tamarisk Marketing, a separate company, under its own separate terms and billing — see Section 8 of the Entertainer Listing Agreement.
THE SITE AND ALL LISTINGS ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT ANY ENTERTAINER LISTED ON THE SITE IS QUALIFIED, LICENSED, INSURED, OR SUITABLE FOR ANY EVENT, OR THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS ARISING FROM A BOOKING, PERFORMANCE, OR TRANSACTION BETWEEN A CUSTOMER AND AN ENTERTAINER, SINCE THE COMPANY IS NOT A PARTY TO THAT RELATIONSHIP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE.
You agree to indemnify and hold the Company harmless from any claim, loss, or damage (including reasonable attorneys' fees) arising from your Content, your use of the Site, your violation of these Terms, or, for Entertainers, any dispute with a Customer arising from a booking.
We may suspend or terminate your account or listing at any time for violation of these Terms, non-payment, or other reasonable business cause. You may stop using the Site or request account deletion at any time by contacting us.
We may update these Terms from time to time. We will post the updated version with a new "Last updated" date. Continued use of the Site after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of [governing-law state — to be confirmed with counsel], without regard to conflict-of-law principles.
