This Entertainer Listing Agreement ("Agreement") is between you ("Entertainer," "you") and The Entertainment Marketplace ("we," "us," "our"), and governs your entertainer listing on the Site, in addition to our Terms of Service and Privacy Policy. By creating a listing, you agree to this Agreement.
The Entertainment Marketplace is a directory. We list your act so Customers can find and contact you directly. We do not book, contract, or process payment for your performances — you handle quoting, contracting, and payment with each Customer yourself, outside the Site.
You choose one of three listing tiers:

Video and audio are external links you provide (YouTube/Vimeo for video; SoundCloud/Spotify/Bandcamp for audio) — we don't host that media ourselves, only your photos.
Founding-roster pricing: if you join before the Site's public launch, you pay a discounted founding-member rate instead of the standard rate above — currently $5 (Basic), $7 (Premiere), or $12 (Pro). This founding rate is locked in for two years from your signup date. At the end of that two-year period, your listing renews at the standard annual rate shown above for your tier, unless you cancel first. We will notify you before your rate changes.
Listing fees are one-time annual payments processed through Stripe at signup and at each renewal — not an auto-renewing subscription. Renewal is handled by us reaching out to you directly; we do not automatically charge your card again without notice.
Your listing fee is due at signup, before your profile is reviewed. Refund requests submitted within 30 days of payment will be honored. After 30 days, listing fees are non-refundable, including if your listing is later suspended or removed for violating this Agreement.
New listings are reviewed by us before becoming publicly searchable (typically within 24–48 hours once we're publicly live; founding-roster listings are reviewed ahead of public launch so they're ready to go live on day one). We may decline or request changes to a listing that is inaccurate, misleading, or violates this Agreement or our Terms of Service.
You represent that: (a) all information in your listing is accurate and kept up to date; (b) you own or have the right to use any photos, videos, or other content you submit; (c) you are legally authorized to provide the entertainment services you list (including any required licenses, permits, or insurance for your category); and (d) you are an independent business, not an employee or agent of the Company.
We are a directory, not a booking agent or party to any agreement between you and a Customer. We do not guarantee any minimum number of inquiries, leads, or bookings. We charge 0% commission on any booking, always — your listing fee is the only amount you ever pay us for the marketplace itself.
Renewal is a manual process: we will contact you before your founding-rate lock (or standard-rate term) ends to arrange renewal at the then-current rate. If you do not renew, your listing becomes inactive but your account is not deleted.
At signup, you may optionally add a website/marketing package from our sister company, Tamarisk Marketing ($12/mo, billed and provided by Tamarisk directly under its own separate service agreement — not part of this Agreement). If you opt in:
By submitting photos, videos, or other media for your listing, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, distribute, and create edited or cropped versions of that content: (a) on the Site, in connection with your listing; and (b) in our marketing and promotion of the Site and its entertainers — including social media (Instagram, Facebook, TikTok, and similar platforms), our website, email newsletters, and advertising.
This license continues for as long as your listing is active. For content we've already published in our marketing, it continues after your listing ends — we're not obligated to take down past posts, but we'll stop new use of your content. You keep full ownership of everything you submit; this is a license, not a transfer.
You may request that a specific photo or video be excluded from future marketing use by contacting us at theentertainmentmarketplace@gmail.com. We'll honor that request going forward. It does not apply retroactively — we're not obligated to remove content we've already posted before your request.
We may suspend or remove your listing for violating this Agreement, providing false information, or other reasonable business cause. You may deactivate your listing at any time by contacting us; listing fees already paid are non-refundable beyond the 30-day window in Section 3.
You are an independent business. Nothing in this Agreement creates an employment, agency, partnership, or joint-venture relationship between you and the Company.
Our liability under this Agreement is limited as described in Section 11 of the Terms of Service. In particular, we are not liable for any dispute, loss, or damage arising from a booking or performance between you and a Customer.
This Agreement is governed by the laws of the State of [governing-law state — to be confirmed with counsel].
